| 摘 要： | 刑罚本质理论是一个非常复杂的问题。研究西方学者对刑罚本质的认识有利于建立现实、合理而有效的刑罚体系，促进刑罚本质的理性化，有助于调整国家的刑事政策方向，摆正刑罚在社会综合治理中的合理位置。

| Abstract: | The theory of penal nature is an extremely complicated problem. The study on the penal nature in the western scholars tends to set up a realistic, rational and effective penal system and promote the rational process of penal nature;to adjust the orientation of the government penal policies and put penalty on an appropriative place in the comprehensive way. |
