| 摘 要： | 多边环境协定与多边贸易体制之间无论在基本理念或是具体制度上都存在着一定的冲突。自由贸易与环境保护都是为实现人类社会可持续发展目标所不可缺少的，但是两者之间的冲突却对国际社会如何兼顾自由贸易和环境保护带来了困扰，也阻碍了我国生态环境保护和对外贸易的发展。面对多边贸易体制和多边环境协定的潜在冲突，我国应该采取以下应对措施，在促进贸易自由的同时又有效的保护环境：（1）积极参与环境协定的制定谈判以推动其改革和创新；（2）在多边贸易谈判中坚持发展中国家的立场和地位；（3）构建和完善我国绿色贸易法律制度；（4）完善绿色贸易的其他相关法律制度；（5）完善我国绿色贸易的法律实施机制。

| Abstract: | On the basic ideas or the concrete systems, there are some conflicts between the Multilateral Environmental Agreements and the Multilateral trade system. Both the free trade and the environmental protection are essential to achieve the sustainable development goal of human society, but the conflicts have brought trouble to the international society about how to pay proper attention to free trade and environmental protection, which also hinders the ecological environment protection and the foreign trade development of China. Therefore, it is necessary to seek solutions. With this aims, this article first analyzes the manifestation of the conflicts, then comments the current ways of solution~ and finally, based on these basics, points out some suggestions for China. |
