| 摘 要： | 土地发展权的国际实践对于中国构建科学的土地发展权制度具有重要的经验借鉴价值。论文对英国土地发展权国有化制度、美国土地发展权的征购和移转制度、法国法定上限密度限制制度,以及台湾地区的容积移转制度等国际主流模式,作了系统而深入的比较分析。这四种模式既在立法依据、设置背景和法律性质上具有相似性,又在权益归属、适用范围和实现方式等方面各具特色。中国应充分借鉴这些经验做法,以立法形式确立土地发展权,明确土地发展权的归属,构建土地发展权流转制度。

| Abstract: | The international practices of land development rights（hereafter LDRs） can provide valuable reference for the establishment of China’s LDRs system.The paper conducts a systematic and in-depth comparative analysis on the international mainstreaming models of LDRs practice,such as UK LDRs nationalization,USA LDRs purchase and transfer,French legal density ceiling,and Taiwan volume transfer.The four LDRs systems mentioned above are not only similar in legislative foundation,legal nature and establishment background,but also different in rights ownership,application scope and realization ways.With the experience of those LDRs systems,China should establish its own LDRs system in a legislation form,clearly stipulate the ownership of LDRs,and set up LDRs transfer system. |
