| 摘 要： | 商业秘密不是传统知识产权的客体 ,在我国财产法中 ,缺少对商业秘密法律属性的确认。商业秘密权是一种特殊的知识产权 ,商业秘密权的范围、取得、内容、行使及法律保护都有自身的特点。应当加强对商业秘密权的法律保护 ,打击侵权行为 ,完善立法规定和司法程序。

| Abstract: | Commercial secret is not the subject of traditional intellectual property. In our country there is no regulation on the right of commercial secret in property law. The right of commercial secret is a kind of special intellectual property. It has its own characteristics in the limits, gaining, contents, performance and legal protection. We should strengthen the legal protection of commercial secret, hit the tort and improve legislation and justice process. |
