| 摘 要： | 涉诉上访作为一种非诉讼纠纷解决机制在这样的背景下应运而生并有迅速发展之势,造成涉诉上访的主要因素有法律真实与客观真实的偏差、司法人员和司法制度的缺陷等。而解决涉诉上访问题的对策主要有：严格遵循民事诉讼中的程序,提高司法人员素质,加强法律宣传教育等。

| Abstract: | As one of the alternative dispute resolution mechanisms,the lawsuit petitioning system emerged as the time require and developed fast at a high speed.There are various factors contribute to the appearance and development of the lawsuit petitioning.The causes can be analyzed as follows: the differences between the legal facts and the objective facts,the imperfections of judicial officers and judicial systems and so on.The corresponding measures are enumerated as follows: strictly observing the civil proceedings,to improve the comprehensive qualities of the judicial officers and enhance the publicity and educational influences of the law. |
