| 摘 要： | 随着依法治校进程的加快和高校学生维权意识的增强,维护高校学生正当的学习权利已经引起教育界、法学界高度关注。受教育者的权利可分为两部分,一部分是受教育者作为公民应享有的权利;另一部分是受教育者作为学生应享有的权利。这两部分权利兼有自由权、社会权属性。按传统理论,对于侵犯他人自由权的行为可以诉诸司法救济,但社会权不具有司法可诉性。高校学生学习权的主要内容有学习自主权、学习保障权、学习成果享受权以及法律法规所规定的其它权力。行使这些权力,应遵守:有利于学习的原则;依法维护学生学习的合法权利,就必须理清教育法理。完善法律机制和健全监督机制。

| Abstract: | With the acceleration of the process of governing universities in conformity with legal provisions and the strengthening of university students' maintaining rights consciousness,maintaining university students' legitimate studying rights causes the high attention of education field and law field.The rights of educated persons can be divided into two parts,one is the right which students should enjoy,and the other is the right which citizens should enjoy.The two parts of rights have the attribute of free right and social right.In terms of traditional theory,we can have recourse to judicial relief to the action of infringing upon the free right of others,but we can't to the social right.The paper has a tentative research of studying right main contents of university students the exercise of studying right and the exercise conditions of studying right. |
