| 摘 要： | 通说认为罗马法的物权（所有权）具有绝对性的特征，但实际上罗马法的物权（所有权）的所谓绝对性仅仅是权利的基本属性一排他性的一种体现而已。通说所认为的罗马法物权（所有权）的绝对性是中世纪注释法学家为了反对封建专制制度，对罗马法所做的有目的曲解而已。罗马法对所有权做了广泛的严格的限制，这种限制表明罗马法的物权（所有权）具有相对性的特征。

| Abstract: | The common theory thinks that the property right of Roman Law has the absoluteness characteristics, however, in fact, the so - called the absoluteness is only the basic attribute of rights--a reflection of no more than exclusiveness. The absoluteness of the property right of Roman Law is only medieval notes jurists＇ purposive misinterpretation in order to object to the feudal autocratic system. Roman Law makes a wide and strict restl：iction on the ownership, which shows the property right of Roman Law has the relativity characteristics. |
