| 摘 要： | 劳动教养制度是我国特有的一种制度,不能否认它为维护社会稳定和治安秩序,教化违法人员起了一定的作用,但它的存在与我们国家的法治目标以及对人权的保护是相矛盾的,其产生的社会背景已经不存在,它的存在缺乏法律依据,而且违背了“过罚相当”原则,所以将其废除是不可逆转的趋势。

| Abstract: | The institution of re-education through labour is one typical of China.It cannot be denied that it has played an important role in maintaining social stability and public security and educating the unlawful.However, there is a sharp contradiction between its existence and our country's target to rule by law.Nowadays,its social background of being has vanished;its existence is short of legal ground,violating the principle that punishment should correspond to the fault.So to abolish the institution has become an inevitable tendency |
