| 摘 要： | 随着社会的发展,土地立体利用的深度和广度正在不断加大,为了顺应这一趋势,我国在制定<物权法>过程中,许多学者都主张在我国的物权法中确立土地空间权法律制度.但是就空间权的性质、构成及是否应当独立存在等问题还存在分歧.

| Abstract: | Along with the development of the society three-dimensional utilization of the earth is being increasingly deepened and widened.In line with this tendency,many scholars argue that spaceright rules should be formulated when Property Right Law is made in China.However,there is still controversy over the nature and constitution of spaceright and whether spaceright should independently enacted as a kind of property right. |
