| 摘 要： | 私有财产权是公民的一项基本权利，公民私有财产权的宪法保护问题，直接指涉公民人权保障的核心。私有财产权的宪法保护有其正当性。2004年3月14日，第十届全国人民代表大会第二次会议审议通过的《中华人民共和国宪法（修正案）》，第一次从宪法的高度对保护“私有财产权”作了明确规定。但是，把对公民私有财产权的保护写入宪法只是实行法治的第一步，我国关于保护私有财产权的法律制度还存在一些缺陷，应当进一步完善私有财产权的宪法保护。

| Abstract: | Private property rights is a fundamental right of citizens, the constitutional protection of citizen＇s private property rights is a central issue of human rights protection. The constitutional protection of private property rights has its legitimacy. The Constitution of PRC Amendment passed at the second meeting of the 10th People＇s Congress of China in March 14th 2004,first defines clearly from a constitutional perspective the protection of private property. It is only the first step of nomocracy to protect citizen＇ s private property in Constitution. There are still some shortcomings on the protection of private property rights of the legal system, and we should further improve the constitutional protection of private property rights. |
