| 摘 要： | 意思自治原则是私法最重要的原则之一 ,其在国际私法中典型的反映便是在涉外合同领域 ,当事人有选择合同准据法的自由。简略回顾意思自治原则形成的历史 ,指出在中国的法治建设中 ,建立成熟的市场经济和增强全球范围内私法领域的趋同 ,意思自治原则将起到十分重要的作用。最后 ,对该原则在中国适用作了几点建议

| Abstract: | The rule of autonomy of will is one of important principle of private law. It's reflection in international private law that client has right to choose applicable law of contract in involving foreign affair. This article briefly review history of the rule's forming and point out that the rule will play a positive role in the construction of law, setting up the system of mature market economy and strengthening global congruence of international private law. At last, author gives some advices about its applying in china. |
