| 摘 要： | 人的自然存在包括肉体和精神两方面,对人的自然存在的保护应该包括肉体和精神两个方面,应承认精神权的独立性.精神损害是以精神权为侵害客体的民事侵权的必然法律后果,而不是侵害其它权利的民事侵权的偶然后果.区别侵害精神权的民事侵权和其它民事侵权,使其成为独立的民事侵权种类,有利于精神权的保护.

| Abstract: | Human being's natrual existence consists of body and mind,so the protection for it should involve two aspects:body and mind.The independence of the mind right should be admitted.Mind damages is the necessary legal outcome of torts in which mind right becomes the invasion object,not occasional legal outcome of other torts.Distinguashing the tort on mind right from others and making it to be the independent kind of tort will benefit the protection for mind right. |
