| 摘 要： | 形成权是由单方行为即可导致法律关系变动的权利。这一概念是在德国进行新的权利分类和实体法与诉讼法的体系划分的背景下产生的,其与请求权和支配权均有着密切的联系。形成权概念对民事权利体系、诉讼理论及民法设计具有重要的意义。

| Abstract: | The forming right is the right whose legal relation can be changed only by the action of one side.This conception is produced under the background while Germany divides the systems of the new right classification,the entity law and procedural law,which has close relation with begging right and control right.The conception of the forming right has important meaning with regard to civil right system,civil law design,and legal theory. |
