| 摘 要： | 行政赔偿责任是国家赔偿责任的重要组成部分,也是行政赔偿责任制度的基本内容和核心范畴。《中华人民共和国国家赔偿法》的颁布实施,正式确立了我国的国家赔偿制度,有利于保障公民的合法权益,促使国家行政、司法机关依法行政、司法。笔者就建立行政赔偿制度的理论基础及意义,行政赔偿责任的各构成要件的特征,论述我国行政赔偿制度建立的必要性和我国行政赔偿制度的性质,归责原则和赔偿范围。

| Abstract: | The administrative indemnity responsibility is an important part of the State indemnity. It is also the basic content and core of admniistrative indemnity system. The issue of THE REPUBLIC OF CHINA STATE INDEMNITY LAW established our country' s state indemnity system officially. It is in favor of protecting citizen' s legal rights, impelling administrative organs and judicial organs use their power following law. The author will inquire in the basic theory, significance, constitutive requirements, imputation principls and scope of admicistrative indemnity in this article. |
