| 摘 要： | 讯问录音录像在讯问的密室中扮演着“第三只眼睛”，在一定程度上起到遏制刑讯逼供的作用，但是由于相关法律未将录音录像的证据属性予以明确，导致司法机关在实践中对该资料的处理方式也不统一；学界亦未形成一致观点。其实判断刑事诉讼中形成的材料是否可以作为证据使用，应当审查该材料是否具有证据的“三性”，即客观性、关联性、合法性。因此，在具体案件中，应当采用具体问题具体分析的方法，准确判断讯问录音录像材料的法律属性。

On the Legal Attributes of Synchronous Interrogation Audio Recording and Video Recording |

| Abstract: | Interrogation recordings and videos in the interrogation of the chamber plays a role of “a third eye” ,which prevents extorting confessions by torture to a certain extent .However ,as the relevant laws and regulations do not make clear the evidence attributes of audio recording and video recording ,the ways that judicial offices used in practice are not uniform .Academics still do not form a consensus point of view .In fact ,to determine whether the criminal proceedings in the form of material can be used as evidence ,we should examine w hether the material has evidence of the “three attributes”,namely objectivity ,relevance , validity .Therefore ,in specific cases ,the methodology for specific analysis of specific issues should be adopt‐ed and the legal nature of interrogation audio and video recording material should be accurately determined . |
