| 摘 要： | 反垄断法的目标一直是经济法学界争论的热点问题,理论上争论不休的局面,带来了司法实践中在垄断行为认定标准上的分歧,从而导致同类案件不同的判决结果。2007年8月通过的《反垄断法》在第一条中规定了该法的目标,但是如何解读该条的规定,学界仍然存在争论,其焦点在于：反垄断法的目标究竟是“竞争机制”本身还是该条文后半部分规定的各种“利益”和“价值”,以及如何协调“竞争机制”本身与各种“利益”和“价值”之间的关系问题。在反垄断法已经出台的今天,对其目标的界定已经成为理论和实务界无法回避的问题。

| Abstract: | The aim of antimonopoly law is an argumentative issue in the area of economic law.This disagreement in theory leads to the diversity of the courts' judging standards in the antitrust cases,hence the different decisions.There are also different opinions on Article One of China's Antimonopoly Law which has passed August 30,2007.The Key point is that whether the goal of antimonopoly law is competitive mechanism or other benefits and values and the relationship between them in Article One.After China's Antimonopoly Law has passed,it is desirable for us to study the issue. |
