| 摘 要： | 地方政府债务是当下社会关注的热点问题,加快地方政府债务监管立法迫在眉睫。欲进行相关立法,首先要廓清该法的基本原则,才能使具体监管规则的设定重心突出,达到"形散神不散"的功效。结合其他国家地方政府债务监管经验,分析了地方政府债务监管基本原则的内涵、冲突及其选择,提出我国地方政府债务监管法律应该具备四项原则并对各原则内容进行了阐述。

| Abstract: | The local government debt is a hot issue of the society .It is urgent to strengthen the local gov‐ernment debt regulatory legislation .About the legislation ,the basic principles of the law should be firstly clarified to make the specific regulation be focused and highlighted .Combined with local government debt regulatory experience of other countries ,the connotation ,conflict and choice of the basic principles of super‐vising the local government debts are analyzed .It is proposed that the legal supervising of the local govern‐ment debts in China should conform to four principles and then the content of the principles are discussed . |
