| 摘 要： | 旅游法的名称、与旅游管理体制改革的关系、立法宗旨、调整范围是旅游法立法必须思考的几个基本问题.由旅游活动的本质及其发展规律所决定,旅游者主权理念应成为未来旅游法的立法宗旨,旅游法应合理确定其调整范围,以突破产业立法的狭隘思路,并积极推动旅游管理体制改革.

| Abstract: | The name,the relationship between the tourism law and the tourism regulatory system reforms,the principal aim of legislation and the regulating scope are essential issues on the legislation of the tourism law.Determined by the nature of tourism and the law of tourism development,the tourist sovereignty ideas should be the principal aim of legislation in the tourism law and the regulating scope of the tourism law should be reasonably determined in order to go beyond the narrow view of the industry legislation.It should also push forward the reforms of the tourism regulatory system. |
