| 摘 要： | 保险代理人经授权可有很大权限，但在行使过程中，又存在很多问题。行使缔约权时，可能出现表见代理的多种情形；行使受领权，又存在可归责事由的问题和与保费交付相关的权利无法界定的难题。加强对保险代理人的监管和规制将有利于其更好发挥代理作用。
