| 摘 要： | 法律与道德既有明显的区别，又有错综复杂的联系，因此在司法实践中处理二者的关系时，对法有明文规定的应严格依法办案，对引起争议的法无明文禁止的私权力行为，主张应放弃法律手段而保留道德惩罚的空间。协调好道德与法在司法实践中的关系就一定要坚持法律评价，而不能用道德评价代替法律评价，造成“法治”表象下的实质的“人治”。

| Abstract: | By analyzing the differences and the relation between law and morality, this paper proposes a guideline to coordinate the two, that is, abide by the bill when explicitly stated in the bill, or consider morality alternative when not forbidden in the bill, while insisting on the appraisal standard of law constantly. |
