| 摘 要： | 中西方法律化中人格观念，在关于人的本质、人性价值取向等方面存在差异，这直接决定了中西方法律传统的不同。这些差异，是由中西方各自独特的化类型及其思维方式和社会特点所决定。中国的法治建设，不仅仅在于制度层面。更应深入反思中国传统化。

| Abstract: | The distinction of personality in the culture of the Chinese law and Western Law lies in the essence and value of people, which cause s directly the distinction of law culture between the two kinds of law tradition . The distinction is based on their unique culture,their different thinking proc ess and social characteristics. So,besides system,the construction of Chinese le gal system should reflect Chinese traditional culture. |
