| 摘 要： | 我国《涉外民事关系法律适用法》规定了遗嘱继承和遗产管理的法律适用，填补了我国这方面的立法空白。但该法关于继承关系的法律适用，仍然存在一定的问题和不足，包括同一制和区别制、遗嘱能力的法律选择、重叠性的冲突规范以及无人继承财产的法律规定等方面，相应提出四点完善建议。

| Abstract: | China＇s applicable law to the foreign-related civil relations has been promulgated , indicating that we had made the first perfect private international law and regulations , the law formulates the applicable law to intestate succession and estate management about the applicable law to inheritance relationship , fills in gaps of legislation in this area . However , concerning the applicable law to inheritance relationship , there still exist certain problems and weaknesses , including the unity and scission system , the choice of law of testamentary capacity , the overlapped conflict rules and the provisions of nobody inheriting property , so it is the right attitude that we should have to discuss these problems and weaknesses and seek ways and channels of solving them . |
