| 摘 要： | 从法学基础理论的角度对中国传统法文化与现代法文化的本质区别进行分析,从是否为法律至上,是否为良法之治,是否能有效制约公权行使、保障私权实现等三个方面阐述传统法文化之于现代法文化的区别所在,以期深层次探讨如何正确看待中国传统文化,如何更好地继承和发展中国传统文化。

| Abstract: | The thesis makes an analysis of the fundamental differences between the traditional and modern law culture based on the basic law theories.The article explains their differences from three aspects：whether the law is unprecedented,if the law is beneficial,whether the law can prohibit the exertion of official right and protect the personnel right and so on.The author then explores how to treat Chinese traditional culture deeply and how to keep and develop the Chinese traditional culture effectively. |
