| 摘 要： | 1997年刑法增设了医疗事故罪,该罪自设置以来争议一直颇大,尤其是医疗事故罪的主体问题.文章从医务人员的概念及范围入手,重点就何谓卫生技术人员及卫生技术人员的身份认定;医疗单位的党政、后勤人员能否构成医疗事故罪的主体;医科实习生能否构成医疗事故罪的主体等问题进行探讨.
