| 摘 要： | 宪法学视角下人性尊严的核心内涵是指人基于人之为人的本性而具有的不可侵犯、不可剥夺、不可放弃，而在法律上享有的无差别的人格精神和主体地位．是人的价值基础和权利根源。人性尊严的权利属性决定了其更适合作为宪法基本权利，而不是具体法律权利；人性尊严的价值属性决定了其更适合作为宪法最高价值原则，而不宜单纯地作为人的内在价值。人性尊严作为宪法基本权利所具有的权利功能．包括消极防御功能和积极请求功能两个层面。

| Abstract: | The kernel connotation of humanity dignity from the angle of constitution refers to the inviolable, inalienable and undifferentiated personality spirit and subject position, which is enjoyed legally just because of being humans. It is the basis of value and root of rights of humans. The right property of humanity dignity determines that it is more suitable to treat humanity dignity as a constitutional basic right than as a concrete legal right, while the value property of humanity dignity determines that it is more suitable to treat humanity dignity as the highest constitutional rule than only as human＇s inside value. As a constitutional basic right, humanity dignity has two functions： passive defense and active request. |
