| 摘 要： | 目前,从理论研究与立法趋势两个方面可以大体判断出立法学研究开始迈向"后立法时代"。在此背景下,有必要对立法后评估进行理性的制度设计,而《立法后评估研究》站在中国问题、世界经验的立场上,搜集和梳理、研究了国内外有关立法后评估的立法现状、最新文献资料,同时批判性地借鉴、吸收了国内外理论界的最新研究成果,加以整合和系统化,但又不拘泥既有的结论,提出了一些独到的、因此具有开创意义的命题、概念等,为我国立法后评估制度的理性建构提供了重要参考与借鉴。该书的最大理论贡献在于以极大的勇气对我国立法后评估制度的理性建构进行了大胆的探索与认真的系统论证,将立法后评估的主要要素进行系统提炼,归纳出主体要素、对象要素、程序要素与内容要素等,并作了逻辑严谨、论证充分的理论阐释与实证考察。

| Abstract: | Nowadays, the study in legislation is coming to post-legislation era from theory study and legislation trend./n this context, it is necessary to take a rational system design in the evaluation after legislation. The book Study on Evaluation after Legislation provides some unique and creative proposition and concepts, and provides vital reference and assistance to the rational construction of the evaluation system after legislation. The greatest contribution of the book lies in the bored exploration and careful systematic discussion to the rational construction of the evaluation system after legislation. It systematically refines the main elements and induces main element, target element and content element; moreover, it takes logic and sufficient theoretical explanation and empirical investigation. |
