| 摘 要： | 孔子与亚里士多德是中西方历史上最有影响力的两位思想巨匠,而二者对人性观却作出了截然不同的价值判断,这促使中西方文化形成了不同的价值取向,进而促使中西方法治发展走上了两条完全不同的路。以孔子与亚氏的不同人性观为起点,进一步分析两位先哲不同的法治观及由此对中西方法治价值选择产生的不同影响,可明晰中西方法治发展之异的思想根基。

| Abstract: | Confucius and Aristotle were the most infuluential giant ideologists in histories of China and West.But they had entirely different value judgment about human nature view.Which cause the dissimilarity of value mindset between China and west,Then made the rule of law of China and West walked two totally different paths.This text which base on the different human nature views between Confucius and Aristotle,will further analyse two sages' different views about the rule of the law and the caused different influences about the law value choice between China and West.Hope to clearly the ideology groundwork of the difference between the rule of law from China and West. |
