| 摘 要： | 依法治教是依法治国方略在教育领域的重要体现。随着我国法制社会建设程度的不断深化,教育法制建设已初见成效,但是对于依法治教的消极态度和行为依然普遍存在。消极依法治教主要表现为:消极依法教育行政行为屡禁不止,消极依法治校问题严重,消极守法、护法现象普遍,教育立法倦怠现象突出以及司法介入教育事业困难多。为此,要从加强从事教育工作人员的教育法律与政策培训、加大教育法律法规的宣传力度、加强教育立法以及提高教育行政部门依法行政和学校依法治校水平等方面来综合治理消极依法治教。

| Abstract: | Managing education by law negatively mainly manifested as forbidding negative educational administrative behavior by law without end,the problem of managing school by law negatively being serious,neagtive observance,the phenomenon of safeguarding law being common,the problem of educational legislation being lassitude and the difficulty of judicial intervening educational case.Therefore to comprehensive control of managing education by law negatively,we should primarily strengthen the training of educational policy and law to whom are engaged in educational work,aggrandizing the propaganda of educational laws and regulations,enhancing the education lawmaking as well as promoting the standard of education administration departments’ and administrative ability according to law and schools’ managing school by law. |
