摘    要:教育立法怠惰是指立法机关负有积极履行教育法律、法规及规章的立、改、废的义务,但在有条件、有能力履行的情况下,并未履行立法义务而导致教育立法不到位的现象。教育立法怠惰一般分为显性和隐性两种形态。在依法治教进程中,教育立法怠惰产生了一系列的消极影响,需通过调整立法政策、健全立法制度、提升立法能力等有效措施加以规制。

Abstract:Educational legislation inaction is the phenomenon that Legislature has the obligation to enact,amend or repeal education laws,regulations and rules,but fails to perform the legislative obligations under the conditions and capable of fulfilling.Educational legislation inaction is generally divided into two morphologies:explicit and implicit.In the process of "Managing education by law",educational legislation inaction brings about a series of negative influence.It should be regulated by effective measures,such as adjusting the legislative policies,improving the legislation system and enhancing the legislative competence etc.
