| 摘 要： | 我国现行保险法中被保险人概念过于模糊 ,且对人身保险和财产保险中的被保险人概念统一定义的模式缺乏逻辑和实践的支撑 ,应当修改。可区分定义为 :财产保险被保险人是保险合同上保险金给付请求权的享有人 ;人身保险被保险人是保险合同上被作为保险标的的生命或身体的所有人。现行法关于可保利益原则的规定亦是不妥当的。可具体修改为 :财产保险中被保险人在承保危险发生时对保险标的具有可保利益是保险金给付请求权行使的条件 ;人身保险中 ,受益人的指定以必须取得被保险人的同意为原则 ,并附加部分例外。

| Abstract: | The concept of the assured in our country's insurance law in effect is too obscure, and the pattern that the assured in personal insurance and in property insurance is not supported sufficiently in respect of logicality and reality, which should be amended .the assured can be defined separately: the assured in property insurance means the possessor of the right to request insurance money according to insurance contract and the assured in personal insurance means the person whose life or body is determined as the subject matter insured in insurance contract. In the law in effect the provisions on the jurisdiction in person am of the principal of insurable interest is not proper, either. It can be revised: that the assured in personal insurance is interested in the subject matter insured at the time of loss is the condition for the assured to request insurance money; the agreement of the assured is laid as the basis of the determination of the beneficiary principally and some exceptional provisions can be established. |
