| 摘 要： | 容隐制度的法律规定由来已久,《唐律疏议》对容隐制度规定体系之完备、种类之齐全,为后世留下了典范。在我国现行刑法中,容隐制度匿迹,《唐律疏议》对容隐主体、容隐行为和容隐不适用犯罪的规定,为我国刑法容隐制度的重新回归提供了渊源并指明了方向。同时,容隐制度的法律规定体现了现代刑法的价值追求,为保障家庭稳定与社会和谐提供了法律制度层面上的借鉴之处。

| Abstract: | Concealment System in the law has a long time in China.The complete system and type of concealment system in Tanglv-Shuyi is the model left for future generations.The complete system and type of concealment system in Tanglv-Shuyi provides a source and re-points the direction for the return of modern concealment system,in today that concealment system has disappeared.It also reflects the value of the pursuit of modern criminal law,and provides the legal protection to the family stability and social harmony. |
