| 摘 要： | 行政伦理妥协是公共行政领域一种特殊的价值抉择,因其在实践中表现为择恶弃善或择小善弃大善,故其面临着合法性危机。合法性不仅意味着被公众认同,而且本身必须内含善的因子。行政伦理妥协之所以被接受在于公共行政领域难以实现最优选择,而常不得已而以满意选择代之,但总是努力趋向至善。作为一种非羁束性自由裁量行为,必须对行政伦理妥协进行严格的限定才能保证妥协总是在合法性范畴内。在实践中,要加强对妥协行为的监督,避免虚假的价值冲突,并积极提升行政人员的能力,努力超越行政伦理妥协,实现公共利益最大化。

| Abstract: | Administrative ethic compromise is a peculiar wealth choice in public administration field.Because it always chooses evil but abandons good,or chooses small good but abandons great good,it is faced with legality crisis.Legality not only means accepted by the general public,but also,it must contains good elements.The reason why administrative ethic compromise is accepted is that,it’s dif-ficult to achieve the best choice and often use the satisfied choice instead of it,but always try hard to achieve supreme good.As unrestrictive discretional act,it’s necessary to strictly restrict administra-tive ethic compromise,so as to ensure it plays in the legality scope.When practicing,it’s important to supervise compromise practice and avoid false value conflict,also,to enhance administrative staff’ s ability and try hard to surpass administrative ethic compromise,achieving public good maximization. |
