| 摘 要： | 建筑物因为具有价值大、不易移动、隐匿、毁损等优点,时常成为律师代理财产保全案件的首选对象.但建筑物在现实中有各种纷繁复杂的表现,有的未取得权利证书,有的属于违章建筑物,等等.律师在代理当事人对建筑物申请诉讼保全时,要研究对什么样的建筑物能够申请保全,以确保申请被法院采纳,并避免申请错误给当事人带来损失;同时,又要认真研讨财产保全担保制度的立法缺陷,当遇到当事人无力提供担保或不能提供足额担保时,向法院阐明充足的理由,使当事人得到司法救济,切实维护其合法权益.

| Abstract: | Buildings with the strong points of high value, hard to move, conceal and damage are always the first choices in the property-protection cases deputized by the attorneys. In reality, however, the building cases are numerous and complicated. Some of the buildings have not got property right certificates, and some of them are illegal constructions. The attorneys should choose the right building to apply for the damage- save so that the application can be accepted by the court and the loss can be avoided. At the same time, the attorneys should make a survey of the limitation of our legislation for property protection. When the party cannot provide the surety or enough surety, the attorneys should give the court adequate reasons in order to let the party get judicial remedy and safeguard his legal right. |
