| 摘 要： | 师徒二人的辩词,由于违反同一律和矛盾律,故均不成立。把"半费之讼"当做是合同意义下的"第一场官司",是违反一条叫做逻辑先后律的思维原则的,这是造成人们思想混乱和困惑的逻辑根源。制定合同,却不曾考虑到规则的例外情况,这是造成人们思想困惑的认知原因。法官判决之后,不再执行合同,是问题获解的唯一合理途径。
