| 摘 要： | 《民法典》第1232条在环境侵权领域首次引入惩罚性赔偿制度,在保护环境私益的同时形成了对环境公法责任的有利补充。但结合实践案例来看,该制度当前在适用上仍存在请求权主体宽泛、举证责任规则不当、赔偿金额缺乏法定标准以及与公法责任冲突竞合等问题,在制度的规制完善上更应注重适用范围限缩、合理分配程序责任、建立法定赔偿标准及责任竞合下的顺位抵扣机制以实现其制度价值。

| Abstract: | Article 1232 of Civil Code introduces a punitive compensation regulation for the first time into the field of environment infringement, which provides a beneficial supplement to environmental public law responsibilities as well as protecting environmental personal interests. However, its application in practice still has problems such as broad claimants, improper rules of burden of proof, lack of statutory standards for compensation amount, and conflicts with public law responsibilities. More attention should be paid to application scope reduction, reasonable allocation of procedural responsibilities, establishment of statutory compensation standard and a sequential deduction mechanism in cases of concurrent liability to realize its institutional value in the improvement of the system. |
