| 摘 要： | 网络上离职空姐李晓航网络代购案在北京第二中级人民法院重审宣判。离职空姐李晓航伙同他人采用以客带货的方式从机场无申报通道将化妆品等货物携带入境，法院处以走私普通货物罪，又因8万元的逃税罪被依法监禁3年，此外还要缴纳4万元的罚金。本文结合空姐代购案的审判，对海外代购问题与走私普通货物、物品罪之间的关系进行分析。

| Abstract: | The case of former stewardess LI xiaohang purchase through internet is in judicial review in Second Intermediate People＇s Court of China . Through the way of passengers carrying goods , Li xiaohang and her cohorts use the channel of NOTHING TO DECLARE , bring the cosmetics into the territory of China . She is convicted of smuggling general goods and eighty thousand＇s tax evasion , and or-dered to prison for 3 years. And the fine of forty thousand should be paid. Based on this purchase case , this paper analyzes the relation-ship between overseas purchasing , smuggling general goods or goods. |
