| 摘 要： | 运用文献法、专家访谈法、观察法、逻辑分析法，通过对中美运动员形象侵权典型案例的比较与分析表明：与美国运动员相比，我国运动员形象权的特殊性决定了保护的特殊性．目前我国运动员形象权纠纷产生的主要原因：运动员形象利益归属问题；我国现行的体育管理体制问题；相关法律问题．针对我国运动员形象权保护存在的问题，提出了我国运动员形象权保护的相关对策．

| Abstract: | By the methods of literature study, observation, logical analysis, and interview, based on the comparison and analysis about Sino-America typical cases of athletes＇ right of publicity,this research proposes countermeasures and suggestions about the protection of Chinese athlete＇s right of publicity. The study results show that：comparing with American athletes, the particularity of Chinese athlete＇s right of publicity has decided the speciality of the protection of this right. Main reason is that：First, the issue of the interests ownship of athlete＇s right of publicity. Second,our country＇s current sports administration problem. Third, the relevant legal problem. Direct against the issue that the protection of athlete＇s right of publicity, this research proposes the relevant countermeasures about the protection of Chinese athlete＇s right of publicity. |
