| 摘 要： | 死亡损害赔偿请求权基础一直是民法上一个颇有争议的问题，单一的继承丧失说或固有损失说是难以对其予以概括的。通过对上述两种学说的分析，并结合我国现行法关于死亡损害赔偿的规定，对该请求权的基础进行了分类探究，以寻求死亡损害赔偿请求权的正当性理由。

| Abstract: | The claims of the damages for death on the basis of civil law has always been a contentious issue. It is difficult to be summarized by the single theory of the loss for inheritance, or the theory of inherent loss. Through analysis of these two theories, combined with China＇s current law on damages in the death, the paper explores the basis of the request for the classification, in order to seek the right reasons of the request for the death damages. |
