| 摘 要： | 检察机关行使量刑建议权，这对于起诉权的完善，增加量刑透明度的增强，审判权的法律监督，被告人的合法权益的保护，预防司法腐败等方面均有积极意义。通过量刑答辩，将量刑问题透明化，使辩诉双方都清楚量刑的过程和结果，使判决更容易让人理解和接受，减少不必要的上诉、抗诉，达到减少诉讼成本，节约司法资源，维护法律公正，构建和谐社会之目的。

| Abstract: | Procuratorial organ exercising the power of penalty advice having active meaning towards the strengthening of penalty＇s transparency and legal supervision, protecting accused person＇s legitimate interest and preventing judical corruption. Through the replying to penalty, both of Accusation and Defense can clearly understand the course and result of penalty, which making the judgement more understoodable and acceptable. It can also reduce unneccessary appeal and counterappeal, achieving the aim of reducing lawsuit costs, saving judical resources, maintaining legal just and constructing harmonious society. |
