| 摘 要： | 视听资料在我国是一种独立的证据种类，它对于民事案件的审判具有其他证据无法替代的优越性，我国关于视听资料证据力的认定经历了一个比较长期的发展过程，但由于其本身又具有易于伪造和篡改的缺陷，使得私自录制的视听资料的证据能力难以判断，视听资料在司法实践中的采信规则亦难以把握。本文拟对此方面的问题作一些初步的探讨，为我国今后的证据立法作一些理论上的准备。

| Abstract: | Audiovisual material is a kind of independent evidence in our country. It has advangtage which others can not substite as to the judgement of civil cases,our recognition of Audiovisual material ability has undergone a long term development,but because of its own defect which is easy to be counterfeited and tampered,the evidence ability of Audiovisual material Record privatly are hard to judge,the acceptance rule in judicature practice are also difficult to confirm. This article intend to make some primary investigation about this aspect,pave the way for our evidence legislation in future theoretically. |
