| 摘 要： | 判断某一因素是否是犯罪故意的认识因素的标准是看该因素是否是决定行为严重社会危害性的因素;犯罪故意的认识因素的内容要以决定行为性质具有严重社会危害性的因素为核心内容,包括行为的性质、行为对象、行为的危害结果、行为与结果之间的因果关系、犯罪客体、法定的特定时间、地点、状况和方法、刑法分则规定的特定的明知,而犯罪主体和违法性不宜作为犯罪故意的认识因素的内容。

| Abstract: | The criterion of judging whether a factor is cognitive in criminal intent or not is to see whether this factor is decisive in the action’s severe social harmfulness.The factor that decides the action’s severe social harmfulness is central to the content of the cognitive factors of criminal intent,which includes the nature,object,harmful consequences of the action,the cause-and-effect relationship between action and result;criminal object;specified time,place,conditions and method in legal term,and scientia in criminal procedure.On the contrary,criminal subject and illegality should not be included in the cognitive factors of criminal intent. |
