| 摘 要： | 高校与学生之同的法律关系,是近年来争议颇多的问题,如何确定高校与学生之间的法律关系,又是一个非常重要的问题,明确了这个问题,才能明确双方的权利与义务,才能正确处理高校与学生的法律关系.而通过深入地分析就不难看出,高校与学生之间的法律关系,事实上是一种双重的法律关系,即部分为民事法律关系,部分为行政法律关系.

| Abstract: | The legal relation between colleges and students is a heatedly discussed issue. The confirmation of the relation is very important to identify the rights and responsibilities of both sides, which will help to deal with the legal relation between colleges and students. A detailed analysis will tell us that there are double legal relations between colleges and students, that is, civil legal relation and administrative legal relation. |
