| 摘 要： | 我国2005年7月公布的《物权法(草案)》对拾金不昧者要求获得经济补偿的行为予以了法律建议。文章通过对拾得人的期望补偿值与遗失人的最大补偿值的比较,认为物权法草案的实施有利于弘扬拾金不昧的传统美德,增进社会福利,并且能促进社会主义市场经济的进一步完善和发展,从理论上支持了物权法草案该条款。

| Abstract: | The Draft of Law of Real Right announced in July 2005 has given the right to those who pick up and return lost property and demand economic compensation from the owner.This text compares the expectation of compensation of the picker with the maximum of compensation the owner affords,then concludes that the implementation of Law of Real Right will help to carry forward the traditional virtue of "not pocket the property one picks up",to promote the social welfare,and definitely to promote further perfection and development of the socialistic market economy in China. |
