| 摘 要： | 关于结果加重犯的研究,可谓学说纷呈,观点林立,造成这种现状,一方面是由于结果加重犯本身的复杂性,牵涉到的许多重大理论问题还没解决,理论研究深度尚显不够所致;另一方面,是由于学者们研究方法,观察角度不同造成的。从方法论入手,立足于结果加重犯的立法理由和处罚根据,从应然的角度,对结果加重犯进行了深入的研究,提出了加重结果可能是过失,结果加重犯有可能存在未遂等主张。

| Abstract: | There are various views on serious outcome crime. The reason of which lies n the fact that serious outcome crime itself is complicated, and many issues in theory concerned haven't been settled, which the learners study in different ways and observe from different position. Therefore it's worthwhile to probe into the serious outcome crime. First, the author make a intensive study on the methodology of serious outcome crime based on the causes of its legislation and penalty in the way it should be and put forward that the consequence of this kind of crime can be out of nothing but carelessness and that the crime may end unaccomplished |
