| 摘 要： | 草原保护与草原权属制度密切相关。现行草原权属种类包括所有权、使用权和承包经营权。从关于各种权利的法律规定和实际情况来看，现行权属制度存在着产权虚置、承包经营权物权效力缺损和保护不力的不足，从而造成所谓“公地悲剧”式的草原环境的恶化。为此，必须对草原权属制度进行保护性的完善和创新。

| Abstract: | Grassland conservation is closely linked with its property system. The existing grassland property includes ownership, use right and contract-manage right. Viewed from the legal provisions and practice, there are problems in the existing current grassland property system, such as empty property right, effectiveness loss of contract-manage right and ineffective conservation, etc. These problems lead to the deterioration of the grassland environment, called ＂Tragedy of the Commons＂. Therefore, it is necessary to improve and innovate grassland property system. |
