| 摘 要： | 民法精神和民主因商品经济的发展建立了联系。民法精神的理论指导着民事权利义务规范的实现。当民法精神内化为人的心理和行为时，民法精神即具有了民主意义；民主既是一种国家制度，又是一种民主意识，从更深层次上说，民主也是一种生活方式。民法精神既有与民主的一致性，又促进着民主。在我国社会主义市场经济条件下，大力弘扬民法精神有利于消除民主发展的障碍，推动以完善的民主制度为核心的政治体制改革，是建设民主的必然要求，在这个过程中，民法精神自身也要做一定调整。

| Abstract: | As a result of the development of commercial economy, the spirit of the the civil law has been closely connected with democrocy. The spirit of the civil law directs the realization of the standardization of the rights and duties. When the spirit of the civil law is internalized into human psychology and behaviour, it aquires the meaning of demacrocy. Democracy is a state system, as well as a democratic consciousness, and in a deeper sense it is also a way of life. The spirit of the civil law conforms to democracy on the one hand, and on the other it promotes democracy. Under the conditions of the market economy in China to develop in a big way the spirit of the civil law will help remove the impediment to the development of democracy, and promote the reform in the political system, the key point of which is to perfect the democratic system and which is the inevitable requirements for building democracy. In the course of the reform, the spirit of the civil law itself also needs to adjust itself to a certain degree. |
