| 摘 要： | 国际商事仲裁协议是双方当事人自愿把合同或财产权争议通过仲裁方式解决的一种协议,具有契约性质,是仲裁机构对涉外民商事法律纠纷行使管辖权,排斥法院管辖权的意思表示。仲裁协议是否合法有效,受到当事人的行为能力、案件的可仲裁性和仲裁协议的形式等诸多因素的影响。因此,仲裁机构或法院审查仲裁协议的有效性时应适用何种法律显得非常重要。国际商事仲裁协议的法律适用问题直接关系到仲裁协议的有效性。本文主要从国际商事仲裁协议概述、国际商事仲裁协议法律适用原则以及我国现行立法及实践有关国际商事仲裁协议法律适用现状及对其完善的建议。

| Abstract: | The international commercial arbitration agreement is by nature a contract showing that the interested parties are willing to solve the contract or property disputes through arbitration. It is a declaration of will of the arbitration agencies for jurisdiction, excluding jurisdiction of courts concerning international civil legal disputes. The legitimacy and effectiveness of the arbitration agreement are influenced by many factors such as the party＇s behavior ability, the arbitrability of the cases and the form of the arbitration agreement. Therefore, it is extremely important to decide which law is applicable when investigating the effectiveness of the arbitration agreement. The legal application of international commercial arbitration agreement directly relates to the effectiveness of the arbitration agreement. This paper mainly studies the current situation of the application of international commercial arbitration laws and gives some suggestions to better it from the aspects of its summary, the applying principles and Chinese current legislation and legal practices. |
