| 摘 要： | 共同侵权行为理论研究的逻辑起点应为共同侵权行为概念的明确界定，而概念的界定应建立在侵权行为制度体系的整体框架之内，缺少对制度研究的宏观把握，难免会出现概念界定过于宽泛或过于狭窄而影响到微观制度架构的合理性。共同侵权行为概念的基本要素为主体、意思联络、损害结果及连带责任，由此引入与共同侵权行为相关的一些概念，如单独侵权行为、独立的侵权行为、并发的侵权行为、无意思联络的数人侵权行为、不真正连带责任及分割责任等，最终将共同侵权行为准确地置位于侵权行为法体系中的多数人侵权这一框架之内，避免共同侵权制度内在结构发生“病变”而异化为多数入侵权制度。

| Abstract: | The logical starting point for the theoretical studies of joint tort lies in the explicit definition of the concept of the joint tort while the definition of the concept should be established within the overall framework of the institutional system of torts. For without an approach to the institutional studies on the macro level will inevitably lead to too broad or too narrow a deft- nition of the concept which will affect the reasonableness for the construction of institutions on the micro level. Basic factors for the concept of joint tort are the subject, liaison of intention, harmful consequences, and joint liability. Relevant concepts , i.e. single torts, independent torts, concurrent torts, multi - person torts without liaison of intention, unreal joint liability and severable liability, etc. are herein introduced. Finally, the joint tort are precisely located within the framework of multi - person torts of in the system of the law of tortuous act, preventing the ＂pathology＂ in the inherent structure of the institution of common tort from turning into an institution of multi - person tort. |
