| 摘 要： | 《人口与计划生育法》规定了公民普遍的生育权，从而使生育权由应有权利上升为法定权利。生育权是私权利，属于民事权利中的人格权，它同时也是宪法上的权利。生育权是受宪法和民法共同规制和保护的一种人格权。

| Abstract: | The procreation right was enacted in "Population and Birth Control Law".Then the procreation right turned from natural right into legal right.The procreation right is a kind of private right,which belongs to the personal right of the civil rights.However,it is also one of constitutional rights.In fact,now the procreation right is one of the personal rights which should be regulated and protected by constitution and civil law. |
