| 摘 要： | 维权型群体性纠纷在外在表现形态上以及对社会的影响方面,与单一主体的纠纷不同,但在纠纷性质上,仍无法脱离私益性的本质,并有其自身存在的正当性和积极性价值功能。我国已建立以诉讼为核心的综合性的维权型群体纠纷解决机制,但还不完备,相关程序设计也不尽合理。因此,在肯定司法功能优势的同时,在制度层面构建一种＂类型化＂纠纷解决机制成为当前的重大课题和解决维权型群体性纠纷的最终努力方向。

| Abstract: | The legal right safeguarding type of group dispute,whose existence is of positive and proper value,is the same as individual dispute in terms of the realization and social effect,though the nature is still individual interest based.China has established the dispute solving system cored with suit but the system is not perfect and there are some procedure flaws.Therefore,it is proposed in this paper to set up a "type-oriented" dispute solving system for the legal right safeguarding type of group dispute. |
